National Development and Reform Commission Revises Foreign Investment Management Measures, Individual Residents' Overseas Investments to Be Managed by Filing
The National Development and Reform Commission (NDRC) has released the "Foreign Investment Management Measures (Revised Draft for Public Comments)" and is seeking public feedback from August 21 to September 20, 2026. The revised draft expands the scope of investors to include domestic enterprises, other organizations, and individual residents, and clarifies that overseas reinvestment also falls under foreign investment. In terms of regulation, investors must obtain approval documents or filing notices before implementing foreign investments. The approval authority for individual residents is the NDRC, while the filing authority is the provincial development and reform department of their registered residence or habitual residence.
